Operator-Participant Agreement for Reservation

This Agreement sets forth the terms and conditions under which Staniel Cay Adventures, (henceforth “Operator”, “us”, “we”) in return for payment in the amount indicated as the total cost for service, agrees to provide you (“passenger” “you”, “your”) with services.

1. RESPONSIBILITY: Operator provides services only and is therefore responsible only for the person's tour. The Operator does not offer or provide any other services. If you purchase other services (hotel, rental, etc.) in connection with your tour, those other services are the responsibility of the provider of those services and/or their agent(s).Neither Operator, nor its agents, servants, employees, management, owners or your travel agent, assumes any responsibility for any claim, cause of action, injuries, losses or damages arising from the acts or omissions of any third- parties involved with your tour, or quarantine, disturbances, government restrictions or regulations, damage, inconvenience, loss of enjoyment, loss of pay, disappointment, mechanical breakdown, government actions, strike, lockouts, war, terrorism, weather, acts of God, force majeure, or other factors of causes beyond our control.

2. RESERVATIONS AND PAYMENT: Your credit card information and acceptance of this Agreement are required to secure the tour. Passenger card information will be used to book airline tickets respective to the booking made, and (or) to pay for any cancellation fees or balances owing respectively. Reservations may be made directly online at our website Error! Hyperlink reference not valid. or by calling 242 524 8062. Passenger has a right to request a copy of this Agreement prior to making payment. For bookings made by calling 242 524 8062 or via our website, Staniel Cay Adventures accepts Visa, MasterCard, or Discover.

3. ITINERARY CHANGES AND CANCELLATIONS: The right to a refund if the Passenger changes or cancels a reservation is limited. ALL PAYMENTS (i.e., “tours”) ARE NON- REFUNDABLE AND NON- TRANSFERABLE. Reservations may be changed or cancelled up to 30 days prior to the tour with a payment of a $75.00 Administrative Fee per passenger. Passengers that notify Staniel Cay Adventures at least 2 weeks in advance of their cancellation forfeits 50% of the total price; Any cancellations made 1 week in advance forfeits 75% of the total price; All cancellations made within 6 days of your desired tour date forfeits 100% of the total price. Changes and cancellations can only be made by calling our Reservations Office at 242 524 8062, or emailing info@stanielcayadventures.com .

4. CUSTOMER SERVICE: Staniel Cay Adventures is committed to quality service. In the unlikely event that you have cause for dissatisfaction during your tour, please call 242 524 8062 to discuss the issue with a Customer Service Representative.

Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement
BY SIGNING THIS DOCUMENT, I WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR TO CLAIM COMPENSATION FOLLOWING AN ACCIDENT. I ALSO ACKNOWLEDGE AND AGREE THAT THIS WAIVER COVERS ANY AND ALL MEMBERS OF MY PARTY FOR THE DURATION OF OUR STAY.

In this Agreement, the term “water sport activities” shall include but is not limited to scuba diving. wading, biking, swimming, snorkeling, boating, fishing, hiking, kayaking, paddle boarding, guided tours and all activities, services and use of facilities and equipment either provided by or arranged by Nealco Air Charter Services INC. DBA Makers Air, Staniel Cay Yacht Club LLC, Bahamas Island Tours, and Staniel Cay Adventures a company incorporated under the laws of the Commonwealth of The Bahamas (hereinafter collectively referred to as (“SCA”).

I am aware that participation in water sports and other activities involves many risks and that SCA is not responsible for predicting whether any given area is safe for use or travel. The island of Staniel Cay and surrounding area is not controlled or marked. I accept full responsibility for my own safety and that of all members of my party and agree that neither SCA nor anyone associated with SCA bears any of said responsibility and hereby release SCA from any liability in this regard.

I hereby agree as follows: TO HOLD HARMLESS AND INDEMNIFY SCA AND ALL PERSONS ASSOCIATED WITH SCA from any and all liability for any property damage or personal injury to myself, my party and to any third party resulting from my participation in water sport and other activities, including guided tours, fishing and scuba diving.

This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.

This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Commonwealth of the Bahamas and no other jurisdiction.

Any litigation involving the parties to this Agreement shall be brought solely within the Commonwealth of the Bahamas and shall be within the exclusive jurisdiction of the Courts of the Commonwealth of the Bahamas. In entering into this Agreement, I am not relying on any oral or written representations or statements made by SCA with respect to the safety of water sport and other activities, other than what is set forth in this Agreement.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD ALL ASPECTS OF THIS AGREEMENT PRIOR TO SIGNING THIS DOCUMENT
